Preliminary remark

We are delighted about your interest in our company and our information offerings. Data protection is of particularly high importance to us – not least because of our self-image as a companion to our customers on their journey into the digital future. We would accordingly like to inform you below about the processing of personal data in connection with the use of our websites.

2 Personal data processed

Relevant under data protection law always processing of "personal data". This means all information relating to identified or identifiable natural person (i.e. Specific human being — unlike, e.g., a company). Identifiable means a specific person can be inferred, regardless whether name or similar known. An identification number, online identifier (like login name), or data that in combination allow unique identification (e.g. Location data or IP address and timestamp — i.e. "the person who sat on chair in kitchen yesterday at 15:03" or "the user who visited our website today at 08:17 with particular IP address") suffice to assume processing of personal data.

2.1 General information on the operation of our websites

When visiting any website, personal data is processed. In order for the pages to be sent to your internet browser and used by you, your device's IP address must in every case be processed, and additionally, in order for the pages to be displayed correctly, further information about the browser you used to visit.

We are legally obliged to ensure the confidentiality and integrity of the personal data processed with our IT systems.

For this purpose, we log:

  • The IP address of the accessing computer (for a maximum of 7 days),

  • The operating system of the accessing computer,

  • The browser version of the accessing computer,

  • The name of the file or page accessed,

  • Date and time of the request,

  • The amount of data transferred and

  • The referring URL

The IP address is deleted after a maximum of 7 days from all systems used in connection with the operation of these websites. We can then no longer establish any personal reference from the remaining data.

The data is additionally used to fix errors on the website and to ensure the security of the website. Furthermore, the information is automatically used to deliver the version of our pages that is optimal for your browser and operating system.

We additionally use SSL/TLS and Cloudflare's IT security service to protect you and our online presence. We have concluded a corresponding data processing agreement with Cloudflare for this purpose.

  • The engagement of an IT security service provider takes place on the legal basis of Article 6(1)(f) GDPR due to our interest in protecting and securing our online offering.

Our website is hosted by Amazon Web Services (AWS) in Frankfurt; we have concluded corresponding data processing agreements and EU standard contractual clauses with AWS.

We additionally use Cloudflare as an IT security service provider. We have also concluded corresponding data processing agreements and EU standard contractual clauses with Cloudflare.

The legal basis for this data processing is Article 6(1)(f) GDPR. Our "interest" within the meaning of Art. 6(1)(f) is the operation of the website, the optimal presentation of our offerings and the implementation of the protection goals of confidentiality, integrity and availability of data.

We use the monitoring service from Elastic. This can transmit and store data such as your IP address and activities on a server operated by AWS. You can prevent the collection and transmission of personal data (in particular your IP address) and its processing by disabling JavaScript in your browser or installing a tool such as “NoScript”. Elastic is used in the interest of continuously optimising the website in terms of both content and technology. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR.   • The engagement of an IT security service provider takes place on the legal basis of Article 6(1)(f) GDPR due to our interest in the continuous content and technical optimisation of our online offering.

We additionally use Cloudflare as an IT security service provider and Elastic as a monitoring service. We have also concluded corresponding data processing agreements and EU standard contractual clauses with Cloudflare and Elastic.

2.2 Newsletter

Additionally you can subscribe our newsletter via our website. We need only your e-mail address for this. To ensure no third party registered your e-mail address for our newsletter, we use double-opt-in procedure. On registration we send e-mail to registered address containing unique link. Only once link clicked is e-mail address activated for newsletter dispatch. Otherwise e-mail address deleted from our system after 14 days.

For proof of consent we store, besides e-mail address, timestamp of registration and confirmation plus IP address. This data stays stored, based on our interest in defending against unjustified claims, solely for this purpose up to three years after unsubscription. We reserve right to store e-mail addresses in blacklist for permanent observance of advertising block-list entries upon corresponding request.

As a service provider for newsletter and contact form we use HubSpot; the data transmitted is processed by HubSpot in the USA. To ensure the security of your data, we have concluded a data processing agreement with HubSpot which also includes the EU standard contractual clauses.

In the case of newsletter registration and the sending of newsletters, the legal basis is Article 6(1)(a) GDPR, i.e. your consent, which is documented through registration and confirmation via the double opt-in link. You can unsubscribe from our newsletter at any time; you will find a corresponding link at the end of every newsletter sent.

The newsletters contain tracking pixels which we use to measure the open rate. When opened, a file is retrieved from our service provider's server. This retrieval transmits the IP address, time of retrieval and technical information about the system used.

Legal basis for this — unless explicit consent under Article 6(1)(a) given — is Article 6(1)(f) GDPR; our interest lies in technical and content optimisation of our newsletter based on technical information, target groups and reading habits, and dispatch at times adapted to recipients, for purpose of operating secure and user-friendly newsletter system meeting your expectations and our business interests.

Although the information could technically be attributed to individual subscribers, monitoring of individual recipients is not our intention or that of the service provider we use.

Success measurement cannot be withdrawn separately. If you wish to object to this evaluation, you will unfortunately have to cancel your newsletter subscription with us entirely.

As a service provider we use HubSpot; the data transmitted is processed by HubSpot in the USA. To ensure the security of your data, we have concluded a data processing agreement with HubSpot which also includes the EU standard contractual clauses.

The engagement of a service provider for recording and sending messages takes place on the legal basis of Article 6(1)(f) GDPR due to our interest in efficient and secure registration and dispatch services.

2.3 Contact form

We offer a contact form on our website through which you can get in touch with us. To process your request, we need the following information from you:

  • Name

  • E-mail address

We need this information to process your enquiry, address you correctly and provide you with a response.

Requests via contact form website usually save in our CRM system. CRM system regularly check whether data deletable. If data no longer needed for customer or prospect relationship, or opposing interest customer-side outweighs, we delete relevant data — unless legal retention duty forbids.

As a service provider for our contact form we use HubSpot; the data transmitted is processed by HubSpot in the USA. To ensure the security of your data, we have concluded a data processing agreement with HubSpot which also includes the EU standard contractual clauses.

The legal basis for data processing in connection with the contact form is Article 6(1)(f) GDPR. Our 'interest' within the meaning of Art. 6(1)(f) is to be able to answer your enquiry, i.e. generally to communicate with customers and prospects.

If your enquiry concerns an offer or the establishment of, or questions regarding, a business relationship, the legal basis for this data processing is Article 6(1)(b) GDPR, and we process your data for the fulfilment of a contract to which you are a party or for the implementation of pre-contractual measures taken at your request.

You also have the option of leaving us your telephone number for faster contact. If you provide this, it will also be stored together with your enquiry in our CRM system. Providing your telephone number is voluntary.

The legal basis for your consent, which you can withdraw at any time (see below), is Article 6(1)(a) GDPR. If you withdraw, we will delete your telephone number from our CRM accordingly.

As a service provider we use HubSpot; the data transmitted is processed by HubSpot in the USA. To ensure the security of your data, we have concluded a data processing agreement with HubSpot which also includes the EU standard contractual clauses.

2.4 Request forms for information material, demos, etc.

We occasionally offer forms on our website on an ad hoc basis, through which you can request information and demonstrations relating to our services. We ask you to provide the following information:

  • Surname

  • First name

  • Telephone number

  • E-mail address

We need this information to process your enquiry, address you correctly, provide you with a response, clarify follow-up questions or arrange an appointment.

2.5 Online application 

Personal data you submit collected, processed and used for purpose of deciding on establishment of employment relationship per Art. 6(1)(b) GDPR and, where applicable, § 26(1) Federal Data Protection Act. Provision of your personal data necessary for handling application process and deciding on establishment of employment relationship. Without provision we regrettably cannot consider you in selection for advertised position. 

No automated decision-making takes place. 

We provide you with the required information pursuant to Art. 13 GDPR upon receipt of your application by means of a reply e-mail. To assess your documents, they are forwarded to the responsible employees and to the responsible contacts/team leaders of the respective specialist team for which the application is intended.  

Other legal entities within the TIMETOACT GROUP are generally separate controllers in their own right. The persons involved in the recruitment process may, depending on the position, belong to different companies within the TIMETOACT GROUP. Your data may therefore be transmitted within the TIMETOACT GROUP to the respective persons. 

An exchange of your personal data with other legal entities within the TIMETOACT GROUP takes place in particular for contract fulfilment as well as on the basis of our legitimate interest in organising internal workflows (e.g. Shared services, carrying out cross-entity transfers).

We do not transfer your provided personal data to a third country, and no such transfer is planned.

Your application documents are stored by us for the duration of the application process and thereafter retained for a further 3 months in order to be able to answer any questions from you. After this period has elapsed, the documents are deleted. Documents submitted by post are returned or destroyed after the 3-month period has elapsed. Should you be employed by our company, your application documents will be transferred to your personnel file.

If you decide to be included in the talent pool, all companies of the TIMETOACT GROUP may access your personal data in the event of possible vacancies and may then contact you to invite you to an interview. You can join the talent pool by ticking the corresponding box during the application process. Your data is processed on the basis of Art. 6(1) subpara. 1(a) GDPR. 

Only with your express written consent pursuant to Art. 6(1) sub-para. 1(a) GDPR do we store your data until withdrawal, in order to be able to contact you in future regarding job vacancies within our company that may be of interest to you.

You have the right to withdraw your consent at any time with effect for the future. The lawfulness of the processing carried out until the withdrawal remains unaffected.

Your personal data, which you provide to us as part of ordering the job subscription, is stored by us until you withdraw your consent to receive news, and is removed from the distribution list after you unsubscribe. 

2.6 Cookies and web analytics

Cookies are small files that are stored on the system with which you visit a website. Cookies can store a wide variety of information, for example login status, an entire shopping basket, or the point up to which a video has already been watched. They are also used as part of tracking to build user profiles, e.g. in order to display offerings of specific interest to the visitor.

On our websites we use technical and performance cookies. Neither performance cookies nor analytics services are called up before you have given your consent to this, but at most technically necessary cookies (whereby we endeavour to avoid even this).

The technical cookies set serve, on the one hand, to store whether and how you have consented to our setting of cookies, and on the other hand, the IT security measures taken to protect you and us.

Performance cookies are used by us to measure the use of our website, to identify errors, for IT security, for the continuous optimisation of content based on usage by website visitors, and to segment our visitors according to demographic criteria.

For this purpose, user profiles are created and stored in a file (the cookie) or similar methods are used to store relevant details about the website visit. These may include, for example, content viewed, pages visited, online networks used, but also communication partners and technical details such as the browser used, the system used and details of usage times.

Visitor IP addresses also stored, but we use IP-masking (pseudonymisation via IP truncation) to protect visitors. Within performance analysis we store no plain visitor data (e.g. e-mail addresses or names), only pseudonyms where applicable. Means neither we nor analytics providers used know visitors' actual identity, only data stored in their profiles or cookies.

This information may subsequently generally also be read out on other websites that use the same web analytics provider and analysed for the display of content, supplemented with further data, and stored on the systems of the web analytics provider. For this further use, the web analytics provider is then the controller within the meaning of data protection law.

We generally only gain access to aggregated information about the success of our websites. However, within the framework of so-called conversion measurement, we can check which of our offerings led to a conversion, i.e. to a deal concluded with us. Conversion measurement is used exclusively to analyse the success of our marketing measures and campaigns.

The legal basis for setting cookies and analytics functions, for which we ask for your consent, is Article 6(1)(a) GDPR. Otherwise, visitor data is processed on the basis of Article 6(1)(f) GDPR, whereby our interest lies in offering efficient, economical and recipient-friendly services. Web analytics also enables us to identify and fix errors on the website, e.g. caused by broken links.

We refer to the privacy notices of the respective providers and the objection options (so-called "opt-out") specified for the providers. If no explicit opt-out option is specified, you have the option of disabling cookies in your browser settings. However, this may restrict functions of our online offering and that of others.

We use Google Tag Manager to control analytics functionalities. Other than the IP address when accessed, Tag Manager itself does not process any personal data, but controls the deployment and invocation of the configured analytics services.

For web analytics itself we use Google Analytics. We are responsible for the collection and transmission of the data to Google; Google is responsible for further processing within the meaning of data protection law. We also use the demographic segmentation function offered by Google Analytics.

Information generated on your use of this website usually transmitted to and stored on Google server in USA. Since we activated so-called IP anonymisation on this website and concluded corresponding data processing agreement with Google, your IP address shortened by Google beforehand within member states of European Union or other contracting states of Agreement on European Economic Area. Only in exceptional cases full IP address transmitted to Google server in USA and shortened there.

On display and storage of cookie settings, two independent tracking pixels transmitted to domain matomo.synaigy.io (belonging to TIMETOACT GROUP GmbH). Collection and processing based on our interest in ensuring functions work correctly, especially in conjunction with campaigns, landing pages and your first visit to our offerings. Only loss rate within web analytics determined, and for this purpose current URL and acceptance/rejection of various consent categories recorded. No personal data collected, and no conclusions can be drawn about individuals or their behaviour flow.

2.7 Map view and route planning

On our websites we offer an interactive map with which you can find us or navigate to us. The map is embedded in such a way that the content is only loaded from the provider once you click on the map preview. By clicking, you give your consent to the use of the map functionality and the associated further data processing by the provider.

Use always requires the provider to process your IP address, since without the IP address the content could not be sent to the browser. The IP address is therefore necessary for display and use. We endeavour to use only such content whose providers use the IP address solely for the delivery of the content.

Providers may additionally use own pixel tags (invisible graphics, so-called "web beacons") for statistical or marketing purposes. These allow evaluation of information such as visitor traffic and usage of provider's content. Pseudonymous information may also be stored in provider's own cookies on visitor's device, containing among other things technical information on browser and operating system, referring websites, visit time and further usage data, and may be combined with such information from other sources.

According to the case law of the ECJ, we as the operator of the website are responsible for the collection and transmission of the IP address and, where applicable, location data to the provider upon use. The provider is responsible for the further processing and, where applicable, collection of further information in connection with the use of the functions.

The legal basis for our processing is Article 6(1)(a) GDPR. You give your consent by activating the functionality by clicking on the placeholder image.

2.8 Automated decision-making and profiling

We do not use automated decision-making on our websites. Profiling on our part is limited to the purposes and procedures described under 'Newsletter' and 'Cookies and web analytics'.

3 Purposes of processing personal data

We process the aforementioned data for the operation and optimisation of our website and our marketing activities, and to fulfil contractual obligations towards our customers.

For enquiries from you outside an active customer relationship, we process the data for sales purposes, contract initiation and advertising. You may object at any time to the use of your personal data for advertising purposes.

4 Voluntary information

Data you provide voluntarily to us, e.g. in forms, and which is not required for the fulfilment of our contractual obligations, is processed by us on the basis that we assume that the processing and use of this data is in your interest.

5 Recipients / disclosure of data

Data you provide to us is generally not disclosed to third parties; in particular, we will not disclose your data to third parties for their advertising purposes.

However, we may use service providers to operate our websites or for further products of ours. In doing so, it may occur that a service provider gains knowledge of personal data. We select our service providers carefully – in particular with regard to data protection and data security – and take all measures required under data protection law for permissible data processing.

In addition, it is possible that, in connection with your enquiries, we pass on data to other members of the TIMETOACT GROUP, of which we are also part, on the basis of Article 6(1)(f) GDPR. Our interest in doing so is to use the resources and expertise of the TIMETOACT GROUP to fulfil your requirements as effectively and efficiently as possible.

6 Data processing outside the European Union

Processing of your personal data outside the European Union (i.e. In a so-called third country) takes place through our use of Cloudflare, Google and HubSpot. Protection of your data is ensured through the conclusion of corresponding data processing agreements and EU standard clauses.

7 Deletion of data

We delete data processed by us in accordance with statutory requirements as soon as

  • a) you as the data subject withdraw the consent required for processing, or

  • b) the further legal bases no longer apply, e.g. because the purpose of processing no longer applies or the data is no longer required for the purpose.

If the data is still required for other legally permissible purposes, it will not be deleted, but its processing will be restricted to those purposes. This means the data is blocked and not processed for other purposes.

This applies, for example, to data that must be retained for commercial or tax law reasons (e.g. Receipts or business letters) or whose storage is necessary for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person.

8 Data protection officer

9 Your rights as a data subject

You have the right to information about the personal data concerning you. For corresponding information, you can contact our data protection officer or us directly at any time. In the case of an information request that is not made in writing, we ask for your understanding that we may need to request proof from you confirming that you are the person you claim to be.

You further have a right to rectification or erasure or to restriction of processing, insofar as you are legally entitled to this. You also have a right to object to the processing within the scope of statutory provisions and a right to data portability, likewise within the scope of statutory provisions.

10 Consents

13 Use of SalesViewer® technology

On this website, data is collected and stored using SalesViewer® technology from SalesViewer® GmbH for marketing, market research and optimisation purposes, on the basis of the legitimate interests of the website operator (Art. 6(1)(f) GDPR).

A JavaScript-based code is used for this purpose, which serves to collect and use company-related data. The data collected with this technology is encrypted using a one-way function that cannot be reverse-calculated (so-called hashing). The data is pseudonymised immediately and is not used to personally identify the visitor to this website.

Data stored as part of SalesViewer® is deleted as soon as it is no longer required for its intended purpose and no statutory retention obligations prevent deletion.

14 Use of Hotjar

We use Hotjar to better understand our users' needs and optimise offering and experience on this website. With Hotjar's technology we gain better understanding of our users' experiences (e.g. How much time users spend on which pages, which links they click, what they like and dislike etc.), helping us align our offering with user feedback. Hotjar uses cookies and other technologies to collect data on our users' behaviour and their devices, in particular device IP address (captured and stored only in anonymised form during your website use), screen size, device type (unique device identifiers), information on browser used, location (country only), preferred language for displaying our website. Hotjar stores this information on our behalf in pseudonymised user profile. Hotjar contractually prohibited from selling data collected on our behalf.

15 Use of the Dealfront (Leadfeeder) tool

Our website uses features of the service Dealfront, a solution for identifying company visitors on our website. Dealfront is offered by Liidio Oy / Dealfront Group GmbH, headquartered in Germany and Finland.

Purpose of processing:
Dealfront analyses visits to our website based on IP addresses in order to provide us with information about company visitors (e.g. Company name, industry, company size, country). Only company data is processed, no personal data of private visitors.

Legal basis:
Processing takes place on the basis of Art. 6(1)(f) GDPR. Our legitimate interest lies in optimising our B2B marketing and better addressing potential business customers.
